Terms of Use

SaigonFilm Television Technology Joint Stock Company (“SAIGONFILM”, “we”, “us”, “our”) provides a platform for managing freelance human resources in film/video production through the SaigonFilm Jobs mobile application (“App”) and the website https://saigonfilm.vn (collectively, the “Services”).

By accessing, downloading, installing or using the Services, you confirm that you have read, understood and agree to be bound by these Terms of Use (“Terms”), our Privacy Policy (linked and incorporated by reference), and any additional rules/guidelines published in the App. If you do not agree, please do not use the Services.

We may modify these Terms at any time. Material changes will be notified via the App, registered email or in-app notifications. Continued use after changes take effect means you accept the new Terms.

1. Service description

The Services connect participants in film/video production:

• Partner (companies, producers)
• Master (project coordinator)
• Freelancer / Key Crew
• Apprentice / Intern

The Services allow creating professional profiles, assigning tasks, tracking progress, mutual ratings, leveling up based on XP and completed tasks, revenue sharing records, and project management.

Important: SAIGONFILM provides only a connection platform and management tools. We are not a recruitment company, do not guarantee work quality, do not collect payments, and are not responsible for disputes among parties (Partner – Master – Freelancer – Intern).

2. User account

• You must use Google Sign-In as the only login method. You are responsible for keeping your account secure and must notify us immediately if you detect unauthorized access.
• Account information must be accurate, complete and kept up to date. You are legally responsible for all activities under your account.
• We may refuse registration, temporarily lock/suspend, or permanently delete an account if we detect violations of these Terms, Vietnamese law, or harmful behavior toward the platform or other users.

3. User rights and obligations

You agree to:

• Use the Services only for lawful purposes and comply with applicable laws.
• Provide accurate information about skills, experience, CV, portfolio and professional profile.
• Perform accepted tasks as committed; respect deadlines, work quality and revenue split agreements.
• Not upload/share content that infringes copyright, is obscene, defamatory, discriminatory, fraudulent, violent, or illegal.
• Not use the Services for unfair competition, spam, illegal data collection, technical interference or system harm.
• Be responsible for contracts, payments, personal income tax, social insurance and any disputes among project parties.

You may not:

• Copy, modify, reverse engineer, decompile or create derivative works from the Services.
• Use bots, scripts, crawlers or any automated tools to access the Services without our written permission.
• Rent, lend, transfer or sell your account.

4. User generated content (UGC)

You retain ownership of content you upload (CV, portfolio, ratings, project files, comments, etc.). By uploading, you grant SAIGONFILM a non-exclusive, royalty-free, perpetual, transferable, worldwide license to store, display, distribute, edit (if needed) and use such content for operating, promoting and improving the Services (including displaying to relevant parties in a project).

You must ensure your content does not infringe intellectual property, privacy, image rights or any third-party rights. We may (but are not obligated to) review, edit or remove violating content without prior notice.

Reporting mechanism: You can report violating content via the “Report” button in the App. We will handle reports under internal policies and applicable law.

5. Payments, fees and revenue sharing

• Any agreements on payments, service fees (if any) and revenue split are established directly among the project parties.
• SAIGONFILM only provides recording and tracking tools (if applicable). We do not collect payments, do not guarantee payment, and do not participate in resolving financial disputes.
• You are responsible for your own tax filings and financial obligations under Vietnamese law.

6. Minimum age & children’s privacy

The Services are not intended for children under 13 (or 16 depending on legal jurisdiction). We do not knowingly collect children’s personal data. If discovered, we will delete the account and related data immediately. Please see our Privacy Policy.

7. Termination and account deletion

• You may delete your account at any time via: Settings → Account → Delete account.
• We may terminate, suspend or delete your account without prior notice if you violate these Terms, are inactive for a long period, or as required by law.
• After account deletion, data will be processed according to our Privacy Policy and the PDPL (No. 91/2025/QH15).

8. Disclaimer and limitation of liability

The Services are provided “AS IS” and “AS AVAILABLE” without any warranties, express or implied (including merchantability, fitness for a particular purpose, or non-infringement).

We do not warrant that:

• The Services will be uninterrupted, error-free, or absolutely secure, or meet all your needs.
• The quality, reliability or conduct of any user (Freelancer, Master, Partner, Intern).
• Any business results, income, or project success.

In all cases, SAIGONFILM and related parties are not liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, data, reputation) arising from your use or inability to use the Services, even if advised of the possibility of such damages.

Our maximum liability (if any) shall not exceed the amount you paid directly to SAIGONFILM in the 12 months preceding the event (typically 0 if the Services are free).

9. Indemnification

You agree to indemnify, defend and hold harmless SAIGONFILM, its officers, employees, partners and representatives from any claims, losses, liabilities, costs (including reasonable attorney’s fees) arising from: (i) your breach of these Terms, (ii) your content or conduct on the Services, or (iii) disputes between you and any third party.

10. Intellectual property

All intellectual property related to the Services (including the SAIGONFILM brand, UI, source code, logo, features, designs) belongs to SAIGONFILM or its licensors. Nothing in these Terms transfers any IP rights to you.

11. Third-party links

The Services may contain links or integrations with Google Sign-In, Google Cloud, Firebase or other third-party services. We do not control and are not responsible for the content, policies or behavior of those third parties. Using Google Sign-In must comply with Google’s terms.

12. Changes to the Services

We may modify, suspend or discontinue all or part of the Services at any time without prior notice, with limited liability as permitted by law.

13. Governing law and dispute resolution

These Terms are governed by Vietnamese law. Any disputes shall be resolved at the competent People’s Court in Ho Chi Minh City, Vietnam.

14. General provisions

• If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
• Failure to enforce any right or provision does not constitute a waiver of such right or provision.
• These Terms constitute the entire agreement between you and us regarding the subject matter, superseding prior agreements.
